Groundless threats

A defendant may restrain the making of 'groundless threats' of court action and may also recover any damages they may suffer as a result of the threats [CA s.202]. Thus a defendant may be prevented from going out of business by the mere making of a threat by a powerful plaintiff and the consequent high legal costs.
