Marks unable to be graphically represented

Examples of these types of marks would include marks which are reliant upon sounds or smells without any accompanying graphical or visual representation or cues. Registration of these types of marks is not impossible, but creates particular challenges.

To be successful, an application for registration of a mark consisting of a sound would need to be accompanied by a comprehensive, unequivocal, written description of the sound; a tune, for example, would need to be accompanied by the musical score.
