Environment and Planning

This chapter provides a broad overview of planning and environment law in Western Australia. However, the emphasis will be on planning law. The contents of this chapter are preliminary and will be progressively amended, including the referencing and citation of legal sources. Due to the complexity of some areas of planning law, compensation for example has not been dealt with in this chapter. However, those interested in the topic should refer to the cases of the
Planning Commission v Temwood (‘Temwood’) and
Griffiths v Minister for Lands, Planning and Environment, (‘Griffiths’) both dealt with compulsory acquisition of crown land.
